DC 37 MEMBERS SICK with COVID-19 to APPLY for WORKERS’ COMP

0

DC 37 urges its members, including those classified as essential workers, front-line workers, and healthcare workers, who have contracted novel coronavirus, COVID-19, to apply for Workers’ Compensation.

In response to the coronavirus pandemic, the New York State Workers’ Compensation Board has extended the window to file a claim by an additional 30 days from the date of your injury or illness. The Workers’ Compensation Board has not changed its rules or application process.

Each NYC agency has in place its own time and leave policies, and you may check your union contract for details.

As a matter of policy, DC 37 does not provide legal representation in Workers’ Compensation matters. However, we are advising members to file Workers’ Compensation paperwork if you believe you contracted COVID-19 on the job or in the line of duty.

In the event that the Workers’ Compensation Board determines that COVID-19 is compensable, you will have the proper paperwork in place.

A list of Workers’ Compensation attorneys is available. If you would like to consult with an attorney, you are free to choose any attorney you wish to represent you in a Workers’ Comp claim.

News and updates may be found on the DC 37 COVID-19 website. If you have any questions, please contact your union rep or the DC 37 Safety and Health Unit, 212-815-1685.

For problems filing your claim, please call the NYS Workers’ Compensation Board Advocate for Injured Workers at 800-580-6665.
